Did Diane von Furstenberg have a case against Forever 21?

Back in March, Diane von Furstenberg filed suit against Forever 21 for copying a couple of her dresses. I understand the suit, as they did pretty much copy the design almost exactly, however, lower-end retailers often copy the styles of designs introduced by high-end designers, why sue now?

Designer Allan Schwartz has created part of his business around copying popular celebrity gown worn at award ceremonies. How is that different? Does he have the express consent of the original designers?

I don't think von Furstenberg would lose much, if any, revenue from the copy. Those that have the money to buy her fashion probably wouldn't shop at Forever 21, and they do place importance on the name. Those that would shop at Forever 21 probably don't have the funds to buy Diane von Furstenberg.

I think she's suing on the principle of it. The dress is a blatant rip-off, and yeah, it might not affect her *too* much financially (although, it is part of her current line, and who is going to want to buy her $325 dress now that teens who shop at malls can buy the exact same thing?). A lot of fashion is being able to spend a lot of money and have other people know that you spend a lot of money.
I think the designer just wants to nip it at the bud so people will think twice before stealing her designs - even if she doesn't win, she will probably still have accomplished that.
